Your Rights

When it comes to your health information, you have certain rights. This section explains your rights and some of our responsibilities to help you.

Please Note: Family Behavioral Health destroys records after 6 years, and therefore cannot respond to record requests beyond that timeframe.

How to Request Records

Your request must be in writing and submitted to the FBH Health Information Management Team at our main address. Please include a notarized copy of your current Driver's License or State ID. We typically provide a summary or copy within 30 days. A reasonable, cost-based fee may apply.

Special Protections: Psychotherapy Notes

Generally, HIPAA rules apply uniformly to all health information. However, Psychotherapy Notes receive extra protections.

Psychotherapy notes are recorded by a mental health professional documenting private counseling sessions. These are kept separate from the rest of your medical record. They do not include medication info, diagnosis, functional status, or treatment plans.

Authorization: In most cases, we must obtain your specific authorization before disclosing these notes for any reason, including treatment by other providers, unless required by law (e.g., mandatory reporting of abuse or "duty to warn" situations).

Access for Parents

Under the Privacy Rule, parents generally do not have a right to access psychotherapy notes about a child’s mental health treatment, as these are primarily for the therapist’s personal use. However, parents as personal representatives can usually receive copies of other medical record information such as diagnosis and symptoms.

How We Use Your Information

We typically use or share your health information in the following ways:

  • Treatment: We share it with other professionals treating you.
  • Operations: We use it to run our facilities, train staff, and improve care quality.
  • Billing: We share it to bill and get payment from health plans. (Patients remain ultimately financially responsible).
  • Public Health & Safety: We share info for preventing disease, reporting adverse reactions, reporting abuse/neglect, or reducing serious threats.
  • Law & Government: We comply with state/federal laws, worker’s compensation claims, law enforcement requests, and organ donation organizations.

Filing a Complaint

If you feel your rights have been violated, contact our Privacy Officer or the U.S. Department of Health and Human Services (HHS). We will not retaliate against you for filing a complaint.
